Privacy Policy

This Privacy Policy explains how personal information is handled on bryndalcapholmai.com (“this site”, “we”, “us”). It is written to meet the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). It replaces an earlier version that relied on European data protection law. European rules are not the framework here. Australian law is. Please read section 5 before you send us an enquiry.

1. Who this policy applies to, and what this site does

This policy applies if you visit this site or submit an enquiry through a form on it.

Bryndal Capholm is an information and referral site. We are not a broker, an exchange or a trading platform. We do not hold your money, open accounts or place orders, and we do not give financial product advice. We publish general information and, if you ask us to, pass your contact details to an independent third-party provider so it can contact you about its own service. See About Us and Risk Disclosure.

2. What personal information we collect

We keep collection to a minimum. We collect:

  • Enquiry details you give us: first name, last name, email address and phone number, and anything else you choose to tell us when you write to us.
  • Technical and usage information: your IP address, device, operating system and browser, the pages you view, and the date and time of your visit.
  • Cookies and similar identifiers placed in your browser. See section 7.

We do not ask for sensitive information as the Privacy Act defines it, such as health information, or for bank details, tax file numbers or identity documents. Please do not send them.

3. How we collect it

In two ways. Directly from you, when you complete a form, such as on Contact Us or Sign Up. Automatically as you browse, through server logs, our hosting and content delivery services, and analytics cookies where you have consented.

4. Why we collect and use it

Under APP 3 we only collect personal information reasonably necessary for our activities. Under APP 6 we use or disclose it only for that purpose, a related purpose you would reasonably expect, or where the law requires it. Our purposes are:

  • to respond to your enquiry;
  • to refer you, at your request, to one or more independent third-party providers so they can contact you about their service;
  • to operate, maintain and improve the site;
  • to keep the site secure and investigate misuse or fraud; and
  • to meet our legal obligations.

Submitting the form is how you ask to be contacted. If you do not want contact, do not submit it.

5. Disclosure — please read this section

If you submit an enquiry, your name, email address and phone number may be disclosed to one or more independent third-party providers, and those providers may telephone you.

You should know that:

  • These providers are separate businesses. We do not control them.
  • Once passed on, the provider handles your information under its own privacy policy, not this one.
  • When a provider calls, ask who they are, where they are based, what their service costs, and how they will use your information. Ask for their privacy policy. You are entitled to say no.
  • Nothing on this site says or implies that any provider is licensed, authorised or regulated.

We also disclose personal information so the site can work: to our hosting provider, which stores the site and its form submissions; to Cloudflare, which delivers and protects the site; to Google, for website measurement through Analytics and Site Kit where you have consented; and to courts, regulators or government bodies where the law requires it. We do not disclose it to anyone outside those categories.

6. Overseas disclosure

APP 8 requires us to tell you if your information may go overseas. It may. The independent third-party providers we refer enquiries to may be located outside Australia. Our hosting, content delivery and analytics providers are global businesses and may store or process information outside Australia. We cannot practicably list every country, because that depends on the provider.

Do not assume Australian privacy protections travel with your information. Overseas it may be subject to the laws of that country, which may give you fewer rights, and enforcing Australian rights against an overseas recipient may be impractical. Where you ask us to refer you after we have told you this, we may not be accountable under the Privacy Act for what that recipient then does.

7. Cookies and analytics

This site uses cookies in four categories: necessary, functional, analytics and advertising. A consent banner appears on your first visit. It is opt-in, so analytics and advertising cookies are not set unless you agree.

We use Google Consent Mode v2, which means analytics storage and advertising storage are denied by default until you choose otherwise. You can change or withdraw your choice at any time through the banner or your browser settings. Details are in our Cookie Policy.

8. Data quality and security

Under APP 10 we take reasonable steps to keep the information we hold accurate, up to date and complete.

Under APP 11 we take reasonable steps to protect it from misuse, interference and loss, and from unauthorised access, modification or disclosure. Those steps include using encrypted connections and limiting who can see enquiry details.

No transmission over the internet can be guaranteed secure, and no system is immune from attack. If a data breach is likely to result in serious harm to you, we will notify you and the Office of the Australian Information Commissioner (OAIC), as the Notifiable Data Breaches scheme requires.

9. How long we keep your information

We keep enquiry details only as long as we need them for the purposes in section 4, or as long as the law requires. Server logs and analytics records are kept for shorter periods. When information is no longer needed, and the law does not require us to keep it, we take reasonable steps to destroy or de-identify it.

Once your details have been passed to a third-party provider, that provider sets its own retention periods. We cannot delete its records for you.

10. Your rights: access and correction

Under APP 12 you may ask for access to the personal information we hold about you. Under APP 13 you may ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading.

Make the request through our contact form. We may need to verify your identity first, so your information does not go to someone else. We aim to respond within 30 days.

There is no fee for making a request, and none for a correction. In limited cases we may charge a reasonable, cost-based fee for giving access, and we will tell you the amount first. If we refuse, we will tell you why in writing, and how to complain.

11. Direct marketing and how to opt out

Under APP 7, if we use your contact details to send you marketing, every message will include a simple way to unsubscribe. You can also ask us to stop, and ask where we got your information, through the contact form. There is no cost.

If an independent third-party provider markets to you after a referral, you must ask that provider to stop. We cannot do it for you.

12. How to make a complaint

If you think we have mishandled your personal information or breached the APPs, tell us first through the contact form. We will acknowledge your complaint and aim to answer within 30 days.

If you are not satisfied, or we do not respond in time, you can complain to the OAIC, the independent privacy regulator. Its complaint form, postal address and telephone details are published at oaic.gov.au. The OAIC normally expects you to raise it with us first.

13. Children

This site is for adults. It is not directed at people under 18, and we do not knowingly collect their personal information. If we learn that we hold any, we will take reasonable steps to delete it.

14. Changes to this policy

We may update this policy as the site, our service providers or the law change. The current version always sits on this page, dated below, and takes effect when published.

15. How to contact us

The only contact channel for this site is our contact form. There is no published telephone number and no published street address.

The legal details of the entity that operates this site — company name, ABN or ACN and registered office — are not published here. If you need them for a privacy request or complaint, ask through the contact form.
