1. About these terms and your acceptance of them
These terms apply to your use of bryndalcapholmai.com, published under the brand name Bryndal Capholm (“this site”, “we”, “us”, “our”). Using the site or sending an enquiry means you accept them. If you do not, please stop using the site.
Read this page with our Privacy Policy, Cookie Policy and Risk Disclosure. Our duties under the Privacy Act 1988 (Cth) apply whatever these terms say.
2. What this site is, and what it is not
This site publishes general information and refers interested people to independent third-party providers. That is all it does.
This site is not:
- a broker, a dealer, an exchange or a trading platform;
- a place where you can open an account, deposit money or place an order;
- a holder or custodian of your money or of any asset of yours;
- a provider of financial product advice of any kind.
We do not execute trades, hold client money or manage anyone’s money. We do not offer or promote contracts for difference (CFDs, a high-risk borrowed-money product).
We do not hold an Australian financial services licence. Nothing here means that we, or any provider we refer you to, are licensed, registered or supervised by ASIC or any other authority.
Nothing here is a recommendation or personal advice. It is general information only, prepared without taking account of your objectives, your financial situation or your needs. Consider whether it suits your circumstances before acting on it.
3. Who may use this site
By using this site or sending an enquiry, you confirm that you are at least 18, have legal capacity to enter a binding agreement, and are not prohibited from using the site under the laws that apply to you. The site is directed at people in Australia. If you are elsewhere, check that your use is lawful.
4. The enquiry process and your details
An enquiry form asks for your first name, last name, email address and phone number. Our enquiry page is headed “Sign up”, but you are not opening an account and you are not buying anything. What happens next:
- Your details may be passed to an independent third-party provider.
- That provider may telephone you on the number you gave.
- The provider explains its own service, costs and conditions.
- You are free to proceed, or not. You are under no obligation.
By submitting the form you agree to be contacted this way. That agreement is what allows a call even if your number is on the Do Not Call Register, so do not submit the form if you would rather not be telephoned. You can tell us, or the provider, to stop at any time. Our Privacy Policy explains how we handle your details.
5. Independent third-party providers
Any provider we refer you to is a separate business.
- We do not control or supervise them.
- We do not guarantee their services, pricing, performance or availability.
- We are not responsible for their conduct, costs or outcomes.
- Any contract you enter into is with that provider, not with us.
Before committing money, satisfy yourself about who you are dealing with. Ask for the provider’s full legal name, what it charges, and how you get your money back. Read its terms and take your time. Pressure to decide quickly is a reason to stop. You can also search the public registers and warning lists at asic.gov.au. That is a resource only, not an endorsement, and we make no claim about any provider’s standing.
6. No financial advice
We do not provide financial product advice, investment advice, tax advice or legal advice. We cannot tell you what is right for you, because we do not know your circumstances.
If you are thinking about investing, please consider getting independent advice from a licensed professional first. The Australian Government’s Moneysmart website, moneysmart.gov.au, is a free public resource on investing, scams and choosing an adviser. We mention it as a resource only, not as an endorsement.
7. Risk
Investing and trading involve real risk, including losing some or all of the money you put in. Past performance is not a reliable indicator of future performance. No return is guaranteed. That applies to whatever a provider offers you, not only to what you read here. By using this site you acknowledge this, and you should read our Risk Disclosure in full before taking any step.
8. Acceptable use
Use this site lawfully and honestly. You must not:
- submit false details, or someone else’s contact details without their permission;
- use the site to break any law, defraud or harass anyone, or impersonate us;
- attempt unauthorised access to the site, or interfere with its operation or security.
We may restrict access if this section is breached.
9. Intellectual property
The text, layout, design and branding on this site are owned by us or used under licence, and protected by copyright and trade mark law. You may not copy, adapt, scrape, republish or commercially use our material without written permission.
10. Accuracy of what we publish
We publish this site in good faith and take reasonable care. Even so, information here may be incomplete, out of date or wrong. So far as the law allows, and subject to section 11, we give no warranty that anything here is accurate, current, complete or suitable for any purpose.
11. Limitation of liability
Nothing in these terms excludes, restricts or modifies any right, guarantee or remedy you have under the Australian Consumer Law, or any other law, that cannot lawfully be excluded. If any part of these terms would have that effect, it does not apply to that extent.
Subject to that, and to the extent the law allows:
- you use this site at your own risk;
- we are not liable for indirect or consequential loss, lost profit or opportunity, or trading losses from your dealings with a provider;
- where our liability can lawfully be limited, it is limited, at our option, to resupplying the relevant services or paying the cost of having them resupplied.
Nothing here limits liability for our own fraud or deliberate wrongdoing.
12. Availability, suspension and changes to the site
We do not promise that this site will always be available or fault-free. We may change, suspend, restrict or withdraw it, or any part of it, at any time and without notice.
13. Changes to these terms
We may update these terms, for example if the law changes. The date below shows when they were last revised. A change applies from the day it is published, not to your earlier use of the site. If you do not accept it, stop using the site. If any part of these terms cannot be enforced, the rest still applies.
14. Governing law
These terms are governed by the laws of the Australian State or Territory in which the operator is based, and by the Commonwealth laws that apply there. You submit to the non-exclusive jurisdiction of the courts of that place. That does not take away your right to bring a claim in another court with jurisdiction, including where you live. Reach us through the form on our contact page. We do not publish a telephone number or a street address.
